Fantage Open Source - Privacy Policy

Introduction
Fantage Open Source values itself on protecting the privacy of our members. All of our staff members have been trained to keep player privacy in mind. We will not share information with others without your consent. We collect only the minimum amount of data needed to operate the game and keep it safe, and we will NEVER sell your information to anyone. All of our staff are instructed not to share personal information about anyone except via Support email only after an identity verification process has been performed. With all of this in mind, we are required by law to provide a privacy policy outlining how we use your data and the procedures for making changes to how we handle your data. This policy may be modified at any time with advance notice being given to our players on major changes once it takes effect.
Location of Data Processing and Collection
Fantage Open Source is based in the United States. Our main website is hosted and processed at data centers in the United States, while our game servers are hosted at Hetzner data centers in Germany. By agreeing to this policy, you consent to allow your personal data tied to your Fantage Open Source account to be transferred, stored, and processed at data centers in both the United States and Germany. The data that will be stored and processed will be subject to United States and German laws concerning data storage and privacy. For California residents, the California Consumer Privacy Act (CCPA) will apply to our California-specific privacy rights disclosures available below. For our players in the European Economic Area (EEA), your data will also be governed by Europe's General Data Protection Regulations (GDPR). For our players in the United Kingdom (UK), the UK's version of GDPR applies.
Our website is hosted on servers in the United States, while our game servers are operated by Hetzner in Germany. Support emails are processed via Pork Bun email services. We use Cloudflare for DNS and security services.
Data Collection
Website Cookies
All visitors to our website will have cookies set on their system by our website with user consent. These cookies issued by us are only used for tracking your account login session. These cookies expire at the end of your browsing session and are not used for tracking purposes beyond your current login session.
Cloudflare sets its own non-expiring cookies for the security services that they provide to us. Information on these cookies can be found in their privacy policy at https://www.cloudflare.com/privacypolicy/.
Analytics
Our website uses Google Analytics via an embed on each webpage to track pages used and to collect small amounts of non-personal data about your system and the general region of the world you live in. We may use Google Advertising services for targeted advertising and marketing purposes in the future. Google sets non-expiring cookies. Cookies they have set on other websites and on their own website may be used for cross-site tracking. You may opt-out of Google Analytics tracking by visiting https://tools.google.com/dlpage/gaoptout/. You may opt-out of Google Advertising personalization by visiting https://adssettings.google.com/. Google's Privacy Policy can be viewed at https://policies.google.com/
Account Creation
When you create an account on our website, we require the collection of some personal data with your consent, including an email address, a username and password, your system IP address, and confirmation that you are 18 years of age or older. This data is used to provide our services to you, to protect your account, and for moderation and safety purposes.
Social Media
We do not collect any personal information on our social media pages. Usage of these pages is subject to the privacy policies of the social media sites those pages are hosted on.
Gameplay Data
While you play our game, we automatically collect data that is needed to operate our game and to enforce our terms of service. This includes typed name submissions, all chat logs in public areas, private group areas, and private messages, gameplay actions you take, avatar stats and progress, and client performance data.
AI Usage
The team may use non-artwork generative AI systems for internal or development purposes. We will not use any player personal data, chat messages or player stats data when using generative AI systems.
System Information
The game will also transmit information about your system specifications and a uniquely generated hardware ID to our servers, both of which are logged for analytics and moderation purposes.
Data Usage
We use all of this data for legal, moderation, and game safety purposes. Select data from gameplay actions, avatar stats, avatar progress, and hardware may be aggregated in a non-identifying manner for our Game Design team, Programming team, Technical Operations team, and others on the team to make important game planning decisions. Some of this aggregate information may be used by Public Relations for stats data that may be published from time to time.
Players who break our Terms of Service will have their infractions recorded by our Moderation department to a permanent record that is maintained by Moderation and is accessible to our Support, and Technical Operations teams for the purposes of ensuring the games and player safety. Account infraction data will not be communicated outside the team except to you via email after an identity verification. In very limited circumstances, we may release infraction data on players who we see as a danger to the game and the community to Fantage Open Source Partners and select trusted communities outside the partner program. We also reserve the right to release personal info, login data, infractions data, and chat logs data to law enforcement if any USA or local laws in your region are broken while playing our game, and we do comply with all valid law enforcement subpoenas and search warrants.
Legal Basis for Collection of Data
In compliance with GDPR, we are required to notify you of our legal basis for collecting your personal data, which is as follows:
- To create and maintain a user account on your behalf per a contractual requirement between Fantage Open Source and the user, and to provide services to the user.
- For legitimate interests for the operation and protection of the game. These interests include protecting you and others who play from inappropriate content, protecting your account from unauthorized access, protecting the game and our team from security threats and other troublemakers, providing support in the event of account issues, data analysis for the purposes of improving the game, processing applications for positions on our team, and handling any legal situations pertaining to a user account.
- To protect the vital interests of the user and others in the event of an emergency.
- To comply with legal obligations in multiple countries. We reserve the right to, and in some cases are required to, disclose personal information to law enforcement in the event of a situation in which a law is broken while using our services.
- To use your data per user consent presented before using services that require the use of personal data.
Legal Transfer of Information
In the event that Fantage Open Source is acquired by or transferred to another entity, this agreement authorizes us to transfer your data with prior notification to you at least 30 days in advance to that entity, which will then become subject to that entity's privacy policy and local laws pertaining to the storage and processing of that data. If you do not agree to this transfer, you may request that your account be deleted by contacting Support prior to the transfer date provided in our notification to you.
Fantage Open Source uses third-party services in order to facilitate the operation of our game and for analytical purposes. By agreeing to this policy, you consent to allow us to grant storage and process your personal data to the extent required by those services and their privacy policies listed earlier in this agreement.
We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of the game, (iii) protect the personal safety of users of our services or the public, or (iv) protect against legal liability.
In-Game Chat Services
We provide in-game chat services for our users to interact with others in the game. As Fantage Open Source is designed for players 18 years of age and older, we provide full typed chat functionality with appropriate content filtering systems. This service allows for typed messages to be sent to other players in the game.
For the protection of our users and to maintain community standards, this service uses both an allowlist and blocklist system to detect and block inappropriate messages which contain personal info, harassment, hate speech, or other inappropriate content. All chat messages are logged, and by using the chat service, you consent to allow us to log your chat messages for moderation purposes. This service is monitored by both automated systems and trained human Moderators, with human Moderators being the only entities who can issue consequences for inappropriate activity. We will use your email address on file to notify you of any infractions issued to you.
Rights to Access, Modify, and Remove Your Data
All account owners have the right via our website or via email to support@fantageos.com to access their account usage data and chat logs collected for them.
Additional account data we have collected on you not shown on the website can be requested by sending an email to Support with two log files from the account in question attached along with your usual location of access. Within 30 days, we will determine if you are indeed the account owner, and if validated, we will assemble your account data in an easy-to-open and read format to be downloadable to you. This downloadable data will only be available to you for 30 days from the time of delivery.
In the event you have personal data that needs to be corrected, outside of data needed to be kept for moderation purposes, you may submit your request via email with two log files attached. Within 30 days, we will determine account ownership and make the change if ownership is verified.
All users can request an account be disabled or enabled by sending a request to Support. Within 30 days, we will determine account ownership and enable or disable the account if ownership is verified.
All users can request that their accounts and related data, including active and backup data, be deleted. This can only be done via email to Support, and we will ask multiple account validation questions and request log files to ensure you are the account owner. Once validated, your account will be disabled and you will have seven days to change your mind. Once the seven days have passed, all account data that is no longer needed will be deleted within 30 days. Please be advised that any data that is deemed by us as needing to be retained for legal reasons or for the protection of the game will be retained.
Some data that we retain on you may be used for advertising and marketing purposes, including potentially through Google Advertising services, with your consent. If you do not want this data to be used for this purpose, you may revoke this consent in your account settings or opt-out directly through Google's advertising settings.
The rights and options described above are subject to limitations and exceptions under applicable law. In addition to those rights, you have the right to lodge a complaint with the relevant supervisory authority. However, we encourage you to contact us first, and we will do our very best to resolve your concern.
Services Security
We take reasonable steps to protect the information provided via the services from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error-free. In particular, emails sent to or from the services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any information via the Internet.
All data is transmitted between you and our services with encryption and all data we store for your account and the game at our data centers is encrypted at rest.
Data Protection Officer
For the purposes of GDPR, we have assigned a Data Protection Officer to our services, which manages all data for the game, ensures compliance with all applicable laws and provides representation for the game in the event of a data privacy issue. California Privacy Rights
This is an appendix addition to our Privacy Policy with additional terms and disclosures as required by the California Consumer Privacy Act (CCPA).
Fantage Open Source is preparing to collect the following information on all of our players once the game launches: personal contact information, unique user and device identifiers, demographic info including age verification data, network connection logs, other internet/communications logs, location info derived from IP addresses. We do reserve the right to combine and infer info collected on you.
As Fantage Open Source is a new service that has not yet launched, we have not yet collected or disclosed personal information. Once operational, personal info collected due to the usage of cloud services to run our game will be disclosed to third parties as necessary for game operations. We may also release electronic, audio and visual info on our players to social media platforms via our posts. Personal information may be shared with advertising services, including Google, if we implement advertising features in the future. In the event of law enforcement requests and reports, we reserve the right to disclose personal info on players who have been globally terminated from our game.
Data is collected when visiting our website and registering for an account, and as you play our game. We also use analytics tools, tracking of social media accounts that interact with our official accounts, and third-party services as defined in our main privacy policy for data collection.
All data collected is for the purposes of operating our game, providing our services to you, keeping our game safe, verifying age requirements, and with your consent, for potential future advertising and marketing purposes.
The CCPA defines "selling" data as "selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to another business or a third party for monetary or other valuable consideration." Fantage Open Source does not receive monetary or valuable consideration from anyone in exchange for the aforementioned data.
Fantage Open Source may use Google Advertising services or other advertising platforms for targeted advertising and marketing purposes in the future. If implemented, these services may use data collected by those platforms and potentially combined with data we provide for advertising targeting purposes.
We do not collect crash reporting data from our game clients.
As a California resident, you have a full right to access any information collected on you that has been used for game operations or marketing purposes. You also have a right to have your info deleted. Both of these can be requested by you or your authorized agent representative by contacting us at support@fantageos.com. We may ask for identifying info to verify your account ownership and all valid requests will be fulfilled within 30 days. Please note that data deletion requests are subject to legal and game protection requirements as defined in our main privacy policy and may be partly or fully rejected depending on your infraction history.
You also have a right to opt-out of the sharing to third parties of your personal info for any purpose. If you wish to opt out, please send your request to support@fantageos.com. Please be sure to say "Do Not Share My Info" in the message to us with your account username(s). Authorized agents for you are also authorized to make opt-out requests on your behalf.
Finally, if you wish to inquire about how we have used your consent for your use of personal info for marketing purposes under California's Shine The Light act, please send your request to support@fantageos.com.
